STANDARD TERMS AND CONDITIONS OF SERVICE

We are Reityn, LLC, a company registered in the state of Indiana. We provide Passenger Services for seniors via membership services as set out in these Terms.
When you book a ride, these standard terms and conditions with appendices apply to your use of the services.
Terms (including pricing) are kept updated and amended periodically. Please check our terms and conditions before making your ride booking.
1. SERVICES
1.1 To use our services, you must create and maintain an active personal profile. You must be at least 18 years of age.
1.2 Profile registration requires you to submit certain personal information, such as your name, address, mobile number, address, and age, as well as a valid payment method supported by us. You are responsible for all activity that occurs using your profile and agree to always maintain the security and secrecy of your Profile username and password. You may only create one Profile unless otherwise agreed by us.
1.3 Upon successful creation of your Profile, you may request a ride by using the website or calling our number.
1.4 Where your ride is fulfilled Reityn, LLC will contact you via text, email, or push notification before the start of the ride, to confirm the vehicle license plate number, drivers details and a picture of the driver.
1.5 Reityn, LLC reserves the right without notice to you to amend the services, if necessary, to comply with the applicable law, statue, regulation, statutory instrument, directives, and all other legislation or if the amendment will not materially affect the nature or quality of the service.
1.6 You are liable for all payment of charges and additional charges for a booking pursuant to these Terms and you must pay the charges and additional charges for each booking.
2. PASSENGER SERVICE CHARGES
2.1. When pick-up and destination addresses have been provided, the amount of additional fees will be billed to the card on file if your ride is outside of the pick-up and drop-off radius.
2.2. Changes to pick-up and drop-off addresses can be modified 24hours prior to pick-up.
2.3. Additional services can be incurred for pick-up and drop-off outside the stipulated 10-mile radius of Fort Wayne as well as driver wait time after the first hour for premium members.
2.4. During the provision of our services, you and all your passengers must:
a) Not smoke, including electronic cigarettes
b) Not consume alcohol nor be intoxicated
c) Always wear a seat belt while in the vehicle
d) Not engage in excessive physical contact
e) Not behave in a disorderly, inappropriate, threatening, or abusive manner, distraction, or danger to the driver.
If you and any of your passengers do not comply with the above conditions, the driver may refuse to commence or continue your ride.
3. PASSENGER SERVICES CANCELLATIONS
3.1. You may cancel/change a passenger service booking without a charge under the following circumstances:
a) You may cancel your ride 24hours before the ride
b) You may change the pick-up and drop-off location 24 hours before the ride
3.2. When you or your passenger do not appear for the service the ride for the day will void and counted as completed.
4. PHOTO/VIDEO POLICY Client authorizes and transfers copyright to Reityn LLC of these images or film to be used in print or electronically. It may contain all surroundings, my person, or anyone in the rental party for lawful purpose, such as publicity, illustration, social media, advertising, and web content.
5. LIABILITY
IN NO EVENT WILL REITYN, INCLUDING EACH OF OUR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR SHAREHOLDERS, BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING DAMAGES FOR DELETION, CORRUPTION, LOSS OF DATA, LOSS OF PROGRAMS, FAILURE TO STORE ANY INFORMATION OR OTHER CONTENT MAINTAINED OR TRANSMITTED BY THE REITYN PLATFORM, SERVICE INTERRUPTIONS, OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES) ARISING OUT OF OR IN CONNECTION WITH THE REITYN PLATFORM, OR THIS AGREEMENT, HOWEVER ARISING INCLUDING NEGLIGENCE, EVEN IF WE OR OUR AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE REITYN PLATFORM MAY BE USED BY YOU TO REQUEST AND SCHEDULE TRANSPORTATION, OR GOODS. YOU AGREE THAT REITYN HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY TRANSPORTATION, OR GOODS OTHER THAN AS EXPRESSLY SET FORTH IN IN THIS AGREEMENT. CERTAIN JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
6. COMMUNICATION
By entering into this Agreement or using the Reityn Platform, you agree to receive communications from us, or communications related to the Reityn Platform at any of the phone numbers provided to Reityn by you or on your behalf, including via e-mail, text message, calls, and push notifications. You agree that texts, calls, or prerecorded messages may be generated by automatic telephone dialing systems. Communications from Reityn, its affiliated companies and/or Drivers, may include but are not limited to operational communications concerning your user account or use of the Reityn Platform, updates concerning new and existing features on the Reityn Platform, communications concerning marketing or promotions run by us or our third-party partners, and news concerning Reityn and industry developments. If you change or deactivate the phone number you provided to Reityn, you agree to update your account information to help prevent us from inadvertently communicating with anyone who acquires your old number. Standard text messaging charges applied by your cell phone carrier will apply to text messages we send.
IF YOU WISH TO OPT OUT OF PROMOTIONAL EMAILS, YOU CAN UNSUBSCRIBE FROM OUR PROMOTIONAL EMAIL LIST BY FOLLOWING THE UNSUBSCRIBE OPTIONS IN THE PROMOTIONAL EMAIL ITSELF.
7. MODIFICATION
Reityn, LLC reserves the right to modify the terms and conditions of this Agreement, and such modifications shall be binding on you only upon your acceptance of the modified Agreement.
8. SEVERABILITY
If any provision of these Terms is deemed or becomes invalid, the validity of the other provisions shall not be affected
9. FORCE MAJEURE
Reityn shall not be in breach of these Terms nor liable for delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from a circumstance not within our reasonable control. In such circumstances we shall be entitled to a reasonable extension of the time for performing such obligations.
